Subject: 9542/Historic District/Battery Place Date: Fri, 1 Mar 1991 16:31:00 -0500 ORDINANCE NO. 9542 AN ORDINANCE TO DESIGNATE BATTERY PLACE, MORE PARTICULARLY DESCRIBED HEREIN, AS A LOCAL HISTORIC DISTRICT AND TO ADOPT THE BATTERY PLACE DISTRICT SPECIFIC DESIGN GUIDELINES. __________________________ WHEREAS, it has been determined that there is a need to preserve and protect the historical and architectural character of the Battery Place neighborhood, as outlined in the attached boundaries; and WHEREAS, on February 19, 1991, the Historic Zoning Commission by resolution recommended to the City Council of the City of Chattanooga that the Battery Place area, more particularly described herein, be designated as a Local Historic District pursuant to the provisions of Tennessee Code Annotated A713-7-402, et seq.; and WHEREAS, the City Council of the City of Chattanooga has reviewed the resolution and report of the Chattanooga Historic Zoning Commission and concurs in the findings of said Commission; and WHEREAS, the City Council has reviewed the Battery Place District Specific Design Guidelines; 0C NOW, THEREFORE, SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Battery Place area be and is hereby designated as a Local Historic District, more particularly described as follows: Property located in the 500, 600 and 700 blocks of Battery Place, being on the northeast line of Battery Place southeast of Georgia Avenue. Lots 1-5, 12, 16, Riverside Division of Lindsays Addition to Chattanooga, as shown by plat of record in plat book 2, page 45, R.O.H.C., lots 5, 7, 9 and 11, block 4, Lindsays Extension of the Town of Chattanooga, as shown by plat of record in deed book K, volume 1, page 433, R.O.H.C., lots 1-14, block 4, and the Burke Home Site, Bluff View Land Company Subdivision, as shown by plat of record in plat book 5, page 63, R.O.H.C., lots 1, 2, and part of lot 3, Burke Subdivision, not recorded, and an unplatted tract. Said lots and part of lots form one tract beginning on the northeast line of Battery Place 135 feet southeast of the intersection of the northeast line of Battery Place with the southeast line of Georgia Avenue (as now located), thence northeast some 310 feet to the southwest line of the Tennessee River, thence southeast some 1118.25 feet with the Tennessee River, thence southwest some 23 feet, thence southwest 136.56 feet, thence southwest 1.47 feet to the northeast line of Marietta Street, thence southwest 30 feet to the southwest line of Marietta Street, thence southeast 159.8 feet with Marietta Street to the northwest line of Mabel Street, thence southwest 225 feet with Mabel Street to the northeast line of Battery Place, thence northwest, southwest, and northwest some 1339.9 feet with Battery Place to the point of beginning. Tax Map No. 135M-L-8-10; 135M-M-1-2, 9-23, and 25-28. SECTION 2. BE IT FURTHER ORDAINED, That the Battery Place District Specific Design Guidelines, attached hereto and incorporated herein by reference, be and are hereby adopted for the Battery Place Local Historic District established herein. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
